1. Terms of Use
This section represents a legal document that serves as our Terms of Use and Service level agreement, and it governs the legal terms of our website, https://equartistech.com, sub-domains, and any associated web-based and mobile applications (collectively, Website), as owned and operated by EquariTech Solutions. Capitalized terms, unless otherwise defined, have the meaning specified within the Definitions section below. This Terms of Use, along with our Privacy Policy, and other posted guidelines within this page, collectively Legal Terms, constitute the entire and only agreement between you and EquariTech Solutions, and supersede all other agreements, representations, warranties, and understandings with respect to our Website and the subject matter contained herein. The latest copies of our Legal Terms will be posted on our Website, and you should review all Legal Terms before using our Website and Services. After any revisions to our Legal Terms are posted, you agree to be bound to any such changes to them.
2. Failure to Follow Policies
Failure to fully comply with these terms is grounds for account suspension and/or deactivation. Any accounts and/or servers contained within Equartis Technologies Pvt. Ltd. network must adhere to the above policies. We reserve the right to remove any account without prior notice. Our standard policy is a warning first, and account deactivation the second offense, but no warning is required. Equartis Technologies Pvt. Ltd. reserves the right to deactivate and/or remove any account or website hosted on our servers that contains any content that it deems in its sole discretion to be unacceptable, undesirable, or contraindicated.
3. Definitions
The terms us or we or our or Equartis Technologies Pvt. Ltd. or the Company refer to Equartis Technologies Pvt. Ltd., the owner of the Website. A Visitor is someone who merely browses our Website but has not registered as Member. A Member or a Customer is an individual that has registered with us to use our Service. Our Service represents the collective functionality and features as offered through our Website to our Members. A User is a collective identifier that refers to either a Visitor or a Member. Service Agreement
The following Service Agreement (TOS or Agreement) apply to all services provided by Equartis Technologies Pvt. Ltd. (we, us, our) to you, the customer. By purchasing services from us, you agree to these terms of service.
1. Orders
In order for a Visitor to become a Customer, an order must be submitted via our billing system. During the submission of the order, the visitor is responsible for the accuracy of all the provided information. Errors during the sign-up process due to order information inaccuracy may lead to service activation delays or rejection. You must be over the age of 18 at the time you place your Order. All orders will be scanned for fraud activity and might be held for manual human verification process. You may receive a notice that your order has been rejected in case it fails to pass our Fraud Verification process. In such cases, no order will be accepted, and no service will be activated until the issue is resolved by manual verification. We may or may not make a reasonable effort to contact you via the provided contact information during the order process to verify your order, and it is your responsibility to contact a company representative via Live Chat, Phone, or Email to info@equartistech.com
2. Account Ownership
The personal information submitted during the sign-up process will be stored in the My Details section of the Customer’s client area. The individual or entity listed in this section is considered the account owner. It is the Customer’s responsibility to ensure accurate details are maintained in this section. Customers must keep contact details such as first name, last name, email, and phone up-to-date, and ensure access to the contact email address used for Client Area/Account login username. The company holds no obligation to provide access, data, or services related to the account if the Client cannot access their Client Area/Account due to lost email access or forgotten passwords. In cases of ownership disputes, the account will be locked until the parties agree on a resolution or until the matter is judicially resolved.
3. Payments
Upon submitting an order, an invoice is generated, and no service will be activated until payment is received. Invoices are due immediately upon receipt, and all fees are net of applicable charges. The Customer is responsible for any additional fees or taxes applied by their bank or payment service provider, including currency conversion fees.
All services provided by the company are set on recurring billing, with invoices issued at least 7 days before the service expiration date, except for services explicitly advertised as One-time services. If services set on recurring billing are not explicitly canceled in compliance with the Cancellation and Refunds policy, the Customer will be charged the applicable fee for service renewal based on its billing cycle and regular service price.
If automatic renewal charges fail, and the Customer fails to renew or terminate the service, the company will make additional attempts to charge credit cards. Attempts will be made on the primary credit card first, followed by other cards listed in the Client Area. If unable to charge any listed credit cards, the service will be suspended until payment is submitted by the Customer. The Company bears no responsibility for loss, including files, emails, domains, or lost profits resulting from service suspension or termination due to non-renewal or expired/invalid credit cards.
Any service not categorized as a Shared Hosting Package, Cloud virtual private server, or Dedicated Hosting server is considered an Extra Service and is non-refundable. Additional Terms of Service may apply to some extra services, as outlined in Third-party Services Terms.
Customers acknowledge that service upgrades are initiated through separate orders with stand-alone invoices. Invoices related to service upgrades are due on the same day, and upgrades are performed only after payment submission. If such invoices are not paid by the customer at the time of the order, payment may be automatically processed within 24 hours unless the client requests otherwise.
4. Price Formation and Renewal
The terms Sign-up Price, Initial Price, Promotional Price, and Special Price apply exclusively to the first invoice and the initial term of the service. Renewal Price, Regular Price, and Standard Price are relevant for any subsequent renewal invoices after the initial term expires. Customers understand that special initial prices are applicable only for the first invoice, and regular renewal prices come into effect once the initial term concludes.
Equartis Technologies Pvt. Ltd. determines service prices based on various factors, including but not limited to infrastructure costs, labor costs for services involving human labor, and the prices of third-party services or products directly or indirectly related to Equartis Technologies Pvt. Ltd. A list of services involving human labor is available on our Support page, and details about third-party services are outlined in the Third-party Services Terms. It’s important to note that these pages may not represent the full spectrum of services and products provided or used by Equartis Technologies Pvt. Ltd.
The company reserves the right to change the price of any product, service, or their corresponding recurring, renewal, or setup fee in the event of substantial price fluctuations in any of the price formation factors. In case of such changes, Equartis Technologies Pvt. Ltd. will make reasonable efforts to notify clients at least 7 days in advance of their product’s due date and renewal through email and the company blog.
Equartis Technologies Pvt. Ltd. also retains the right to modify the terms of any promotion if there is a substantial price fluctuation related to the products involved in the promotion. Current service fees and available payment methods are listed on our website. Customers agree to pay the fees for the respective services indicated on the website at the time of order submission.
The company reserves the right to change fees and plans at any time without prior notification. Fee changes will be effective immediately and will apply to customers as of their next purchase or renewal. Customers acknowledge that all products will be renewed at the Renewal/Standard/Regular price listed on our website after the conclusion of the initial billing cycle/term. Promotional discounts are applicable only to the initial billing cycle/term, and all services will be renewed at the Renewal/Standard/Regular price listed on our website.

6. Uptime, Availability, and Compensation
Equartis Technologies Pvt. Ltd. commits to making Covered Services available with a Service Uptime of at least 98% (Service Uptime Warranty or SUW). If Equartis Technologies Pvt. Ltd. fails to meet the SUW, and the Customer satisfies the conditions outlined in this SLA, the Customer may qualify for Service Credits. Service Credits will be a percentage of the monthly invoices charged for a Covered Service Instance, known as the Service Credit Percentage, for the instance that experienced Service Downtime during the applicable month.
A 99% availability guarantee is provided for the Public Network, excluding scheduled or emergency maintenance. In case of network downtime, a 5% service credit per hour will be applied, up to 100% of the monthly fee for the affected service. Similarly, a 99% availability guarantee is extended to websites/servers, with a 5% service credit per hour of downtime, up to 100% of the monthly fee.
The total value of any Service Credit for a given month will not exceed 100% of the fees invoiced for the applicable Covered Service Instance in that month. The calculation of network availability relies on internal records of Equartis Technologies Pvt. Ltd. and third-party reports will not be accepted as evidence for compensation.
7. Limitation on Company Liability
Equartis Technologies Pvt. Ltd. disclaims liability for indirect, incidental, special, or consequential damages, including loss of profits or revenue resulting from product and service use by the customer or third parties, or any failure of the products and services. The company is not liable for loss or corruption of data, including data loss resulting from delays, nondeliveries, misdeliveries, service interruptions, network failure, server reclamation, server failure, operating system or software reloading, or negligence of Equartis Technologies Pvt. Ltd.
Customers are solely responsible for safeguarding, backing up, and archiving all data owned, controlled, or transmitted by them on Equartis Technologies Pvt. Ltd. network or servers. In no event shall Equartis Technologies Pvt. Ltd. aggregate liability for any claim under this agreement exceed the aggregate amount paid by the customer to Equartis Technologies Pvt. Ltd. in the billing cycle immediately preceding such claim. Equartis Technologies Pvt. Ltd. provides all products and services “as is,” without warranty of any kind, whether express or implied, and disclaims all implied warranties, including but not limited to merchantability or fitness for a particular purpose.
Resource Usage
1. Resource Availability
Shared hosting services do not provide dedicated resources such as CPU cycles, RAM, or dedicated software services. Virtual Private Servers (VPS) share underlying physical hardware, competing for CPU and memory. Dedicated Servers offer fully dedicated CPU cores. The customer must use services within resource usage quotas listed in product pricing tables and this agreement to ensure smooth operation and fairness among customers.
2. Disk and Traffic Usage
Disk space and traffic provided by the company must be used for hosting purposes. Storage of large, uncompressed media files or online backups beyond specified limits is prohibited. Unlimited Storage Plans may be subject to a Fair Usage Policy (FUP) imposed upon exceeding 50 GB in a billing cycle. The customer’s resource usage must not adversely affect global performance, cause service-related issues, delays in regular backups, or high I/O wait. The company reserves the right to request content removal or temporarily suspend access if resources are misused. The terms “unlimited” and “unmetered” are defined based on industry standards and average resource usage.
3. Mail Service Usage
VPS and Dedicated Server Usage:
No size limitations for VPS and Dedicated Server clients.Resource utilization should not compromise global service performance.
Shared Hosting Services:
- Allow up to 10 simultaneous IMAP/POP3 connections.Total email messages should not exceed 500 per hour.Messages exceeding this limit may be deferred and stored for later delivery based on service availability.Spam/unsolicited mailing activity or suspicion may result in temporary suspension.VPS or Dedicated hosting clients can request higher limits, subject to manual approval with proper justification.
4. CPU and Memory Usage

Shared Hosting Usage:
Detailed up-to-date statistics provided for CPU and Memory usage via Hypweb cPanel.Constant resource utilization of 100% for any given hour is not allowed.Customers are responsible for maintaining their accounts and installed software to ensure optimal performance and resource availability for all users.
VPS and Dedicated Hosting Usage:
- Customers can utilize resources as appropriate, ensuring no adverse impact on other resources used by the Company and its customers.
5. MySQL and Other Database Engines Policy

Shared Hosting:
Software and applications cannot utilize more than 30% of allocated resources.Databases on shared hosting are located on high-speed NVMe drives.Query executions longer than 1 second are considered slow.Shared hosting applications or databases cannot generate more than 1% of slow queries per day.
VPS and Dedicated Hosting:
- Customers can use resources appropriately, ensuring no impact on the performance or availability of other resources used by the Company and its customers.
Third-party Services
- Applies to all third-party services provided by Equartis Technologies Pvt. Ltd. services may include third-party software or services for improved user experience, functionality, features, or security/performance.Equartis Technologies Pvt. Ltd. reserves the right to discontinue support or provisioning of these services at any time, with or without notice.Prices for third-party services may change, and extra fees may be applied.The list may not include all extra or third-party services and software included in the hosting service.Example: cPanel/WHM – An online Linux-based web hosting control panel designed to simplify website and server administration.
Cancellation and Refunds
Payments and Renewal Policy
- The Company commits to fair and trustworthy resolution during any cancellation or refund request.If the service is no longer suitable or does not meet customer expectations, the Company will act in the customer’s best interest, following its Terms of Service and Terms of Use.
The Customer understands and agrees that their services with The Company will be billed on a recurring basis unless The Customer informs The Company that they want to cancel any or all of the provided services by submitting a Cancellation Request form in the Client Area. Equartis Technologies Pvt. Ltd. does not provide any money back guarantee for service renewals. It is the sole responsibility of The Customer to make sure that their payment information is kept up to date, as well as all invoices are paid on time or the service is canceled prior to the service due date. The Customer acknowledges that the Company is keeping a copy of the non-renewed shared hosting account for no more than 5 (five) calendar days after the due becomes effective. 5 (five) days after the due date, if the renewal payment is not submitted, any information or data in the account will be deleted, it includes the account, all of its backup copies, and any other information or data related to the account. In case the customer is using a Cloud VPS Hosting or Dedicated Server hosting package, all customer’s data might be permanently deleted within 24 hours after the due becomes effective if the renewal payment is not submitted. This includes all accounts on the Cloud VPS server or Dedicated Server, all of its backup copies, and any other information or data related to the account.
2. Service Cancellation by the Customer
All services that are provided by The Company can be canceled by The Customer. Only requests submitted through the Client Area are considered as valid and will be reviewed by The Company. The cancellation becomes effective in accordance with the time chosen by the Customer through the Cancellation process. After the cancellation request is submitted by the Customer, the Customer’s account will be suspended either immediately or at the end of the service billing period depending on the Customer’s choice during the cancellation process. The Customer acknowledges that the Company is keeping a copy of the canceled shared hosting account for no more than 5 (five) calendar days after the cancellation becomes effective. 5 (five) days after the cancellation becomes effective any information or data in the account will be deleted, it includes the canceled account, all of its backup copies, and any other information or data related to the account. In case the customer is using a Cloud VPS Hosting or Dedicated Server hosting package, all customer’s data might be permanently deleted within 24 hours after the cancellation. This includes all accounts on the Cloud VPS server or Dedicated Server, all of its backup copies, and any other information or data related to the account. After the cancellation becomes effective, the Company cannot be held in charge of loss of data due to suspension or termination.
3. Money-back Guarantee
The Company will refund the hosting fee paid by the customer if the cancellation request meets the following terms: The Customer’s cancellation request has become effective in less than: 30 days for Shared Hosting Accounts; 7 days for Virtual Private Servers (Cloud VPS) and Dedicated Servers (DS); after the date of the first payment for the account. The cancellations of a Shared hosting account, shared hosting upgrades, or extra services, where explicitly agreed, that become effective in more than 30 days after the first payment are not eligible for a refund. The cancellations of a Virtual Private Server (VPS) or Dedicated Server (DS), where explicitly agreed that become effective in more than 7 days after the first payment are not eligible for a refund. The money paid by the Customer for the hosting account(s) will be refunded, excluding the setup and processing fee paid during the signup process. Setup and processing fees paid upon signing up are not subject to refund. If a domain name is registered by the Customer during the initial hosting account order process, then the appropriate domain name registration fee will be withheld. In case of a refund, the domain name registration fee is always withheld, even if this fee was waived at the time of purchase considering, Domain Registration terms of service. In case of a refund, if a free domain name transfer service is provided as a part of the free domain registration/transfer offer, then the appropriate domain name transfer fee will be withheld. The domain transfer fee is always withheld, even if this fee was waived at the time of the purchase. Refunds can only be made to the original source of the payment. If a refund is due, but it is not possible due to failure, the only alternative we offer is supplying the correct amount of funds to the client’s Credit Balance. Possible reasons for a refund to fail, or be declined by the card issuer, would be if the original payment was processed with cards that are limited by their nature (Prepaid cards, Virtual Cards, Disposable cards, etc.) or the card account does not support refunds, is closed, or frozen due to fraudulent activities.
4. Chargeback and Disputes
If you believe there is an error on your billing or charges, you must immediately contact us in writing. We each agree to work together in good faith to resolve any billing disputes. If you initiate a chargeback or PayPal dispute based on this dispute, we may suspend the Service(s) until the dispute is resolved. To reactivate your Service(s), you must first pay all outstanding amount. In addition to all outstanding amount, there might be a chargeback fee associated with chargebacks and pre-arbitrations. The amount of the fee – and at what point in the process it is debited – is dependent on your case. Specific information on chargeback fees can be found in your billing ticket related to the chargeback case. If you’re unsure where to find those, contact us.
5. Service Cancellation by The Company
Any of the services that the Company offers may be canceled by the Company with no prior notice and with no refund in case that the Company finds out in good faith that the Customer’s use of the service violates the Terms of Use or the customer’s account is involved in illegal activity. The Company cannot be held in charge for loss of data if such a cancellation has been done. The Company may also cancel any of its services, if the Company determines in good faith that the service has become impractical or unfeasible for any technical, legal, loyalty, regulatory or other reason, by giving or without giving the Customer as much prior notice as reasonably practicable In case such an issue occurs the company reserves the right to temporarily suspend the service in an attempt to contact the Customer and assist in resolving the issue. If the issue is not resolved in up to 7 (seven) days for all shared hosting services and 3 days for all Cloud VPS and Dedicated Hosting services after the customer has been notified about the issue, the company reserves the right to terminate the service. The services used by the Customer may be canceled for any or no reason by the Company with a preceding 7 days notice. After the 7 day period the Customer’s Account will be ended, and the Customer will be provided with access to an archived backup copy of the Customer’s account content as of the termination date. These backup copies will be available for no more than 7 calendar days. After the expiration of the 7-day period for accessing the archived backup copy, all backup copies and any other information or data related to the account will be deleted from the Company’s servers. If the reason for service cancellation by the Company is different from violation of Terms of Use by the Customer, a prorated refund will be issued by the Company for all the months that the account is prepaid and will not be used by the Customer. The calculation of the amount of the refund will be made by multiplying the number of the unused months by the prepaid monthly price as it is for the Customer’s billing cycle. The Company will offer several options for receiving the refund; still, it is only the Customer’s responsibility to provide the information needed for receiving the refund. The Customer acknowledges that if the reason for service cancellation by the Company is a violation of Terms of Use by the Customer, a refund will not be issued by the Company.

(we, us, our) you agree with us on the PROHIBITED CONTENT AND ACTIVITIES list provided below, containing but not limited to: Hosting of any material in violation of any Country, Federal, State or Local regulation; Websites dedicated to the discussion of hacking activities or the distribution of hacking, cracking, phreaking, and other similar tools; Usage of Equartis Technologies Pvt. Ltd.network to access any device, system, service, or network without the owner’s consent; Infringing any type of copyright, trademark, patent, or other proprietary rights of any party; The usage of mining scripts and the action of mining a cryptocurrency. This includes but is not limited to individual, collective (pools), or cloud mining of any digital currency; Collecting or using email addresses, screen names or other personal identifiers in any capacity, without the consent of the person identified; Impersonating another person or entity regardless of the means and goals; Spamming and Mail Bombing; Spamdexing (also known as search engine poisoning, black-hat search engine optimization); Hosting Proxy or traffic relaying related software; Hosting BitTorrent related software, Warez, etc.; Declare or support the notion of hatred for particular social, ethnical, religious or other group; Host, advertise or transmit Trojan Horses, Worms, Ransomware, Spyware, Adware, Scareware, or any other malicious software or program; Advertising Money Making Schemes, Multi-level Marketing (MLM), Cryptocurrency Giveaways, Fake Guru Scams or other similar activities and events; Hosting, advertising and spreading of fake news, misleading, untruthful or inaccurate information with or without knowledge of the actual source being manufactured; Any type of data that is unlawful, abusive, threatening, harassing, or defamatory; Obscene adult content, child abuse, unlawful harassment, and misconduct of any sort; Advertise, encourage or support the use and/or sale of any non-prescription, prescription pharmaceutical substances, recreational (legal and illegal) drugs, including, but not limited to, items used to manufacture controlled substances and/or drug paraphernalia without permission by the local government or other authority and without the ownership of the appropriate documentation that legalizes such facilitation; Promote, encourage or give any kind of support to violence in any capacity, and terrorism. Note: some or all of the items listed in the AUP can also be found in other parts of our TOS with more or less details and explanation regarding them and the actions we take against them. Integral prohibited activities which have not been listed here may also be listed elsewhere in our TOS. For all issues related to the use of the services not settled by this AUP, the provisions of the TOS shall apply.
